How-To-Beat MERS After Arizona Homeowners Lose Foreclosure ...

The 9th U.S. Circuit Court of Appeals had really no choice but to reject the weak argument presented by Arizona homeowners in their foreclosure case. The homeowners argued that they were misinformed about the operations of how MERS worked. In other words they somewhat relied on the misinformation and suffered injury as a result. Calling MERS a SHAM! Which the homeowners also felt prevented them from contacting the party holding the loan to get a loan modification repayment plan.

In a letter from Judge Conseulo Callahan writing from the unanimous three-judge panel, said that ?Mortgage Electronic Registration System is a legitimate way for lenders to store deeds when the loans are transferred from one lender to another.?

This is where Improper Mortgage Securitization comes into play. Why every homeowner facing foreclosure, foreclosure defense lawyers, and forensic loan auditors need to understand when securitization is flawed. Most importantly those trying to stop or void foreclosure need to know how to explain when improper mortgage securitization exists!

The problem with MERS is that while they are setup to store deeds when loans are transferred from one lender to another which is legitimate but if securitization is improper the holder receiving transfer is NOT a Holder In Due Course. Now it becomes a universal problem for MERS because this is a violation of Uniform Commercial Code.

This is where MERS will die when using the Improper Mortgage Securitization foreclosure defense. So MERS acts as an nominee, a separate entity to store the deeds being transferred? This answer to this question is yes. Okay, it is a legitimate business model! But what authority is expressly given in the NOTE that grants MERS permission to transfer the NOTE with the deed?!! The Arizona homeowners Did NOT argue this important foreclosure defense and would prove improper mortgage securitization exists! Why? I have YET to see one note that grants MERS such authority. Believe me I have inspected thousands of mortgage notes including my own.

Consider This:

?Even if we were to accept the plaintiffs? premises that MERS is a sham beneficiary and the note is split from the deed, we would reject the plaintiffs? conclusion that, as a necessary consequence, no party has the power to foreclose,? Callahan wrote. She said such a claim could succeed only where MERS initiated foreclosure in its own name, or where the designation of MERS violates state recording and foreclosure statutes, neither of which is at issue here.

This is silly on behalf of the Arizona homeowners because essentially a loan was originated and somewhere somebody is owed! This prime example of wearing a t-shirt that says ?Give Me A FREE House Please I Am A Deadbeat?.

For MERS this gets even more complicated because certainly there are thousands of homes that were foreclosed in MERS name and listed as the lender in the legal paper. That class action coming SOON is to be continued, let?s just hope those homeowners have good legal representation that know what Improper Mortgage Securitization is and HOW to explain it.

Could the Arizona homeowners have won against MERS? If they argued the foreclosure defense of Improper Mortgage Securitization they could have easily won. After all contracts such as a mortgage NOTE is governed by Uniform Commercial Code. Another killer for MERS is fabrication of mortgage assignment transfers and the use of Robo signers. Every mortgage assignment must be fact checked by the assignor! Was it ever examined did MERS violate state recording and foreclosure statutes? There are too many things wrong with why the Arizona homeowners were defeated by MERS.

(AP) ? Hundreds of Libyans converged Saturday on a main square in Benghazi and another in Tripoli in response to a call from the military to hand over their weapons, some driving in with armored personnel carriers, tanks, vehicles with mounted anti-aircraft guns and hundreds of rocket launchers.

The call by the Libyan chiefs of staff was promoted on a private TV station in August. But it may have gained traction in the wake of the attack against the U.S. consulate in Benghazi in which the American ambassador and three staffers were killed. The incident was followed by a popular uproar against armed militias which have increasingly challenged government authorities.

In response, the government has called on all militias to disband or join a command center coordinating between the army and the militias. The government had relied on many militias for security during the turmoil following last year's ouster and killing of longtime leader Moammar Gadhafi.

Army Col. Omran al-Warfali said the turnout has been impressive.

"Hundreds of citizens came since the early hours of this morning to handover their weapons from all segments of society, men and youth, women, and even children came to hand over bullets they found it in the streets," he said.

Previously, the government had estimated that over 200,000 people in Libya are armed. It has attempted a number of disarmament schemes, including offering people jobs in exchange for handing over their weapons, or offering to buy guns. Those offers have shown few results.

A military official has been urging citizens in ads on a popular TV station to hand in their weapons. The station, Libya alHurra or Free Libya, showed live footage of Saturday's collection and transfer of weapons to military barracks.

Ahmed Salem, an organizer of the efforts in Benghazi, said over 800 citizens handed in weapons at the main collection point. Over 600 different types of arms were collected, including anti-aircraft guns, land mines, rocket launchers and artillery rockets.

Moussa Omr, a former fighter who lives on the outskirts of Benghazi and who fought against Gadhafi, said it was time to turn over his weapon to the state.

"When I saw the announcement on television I came to Benghazi with my wife and son to hand over my weapon to the national army because I want to move from the stage of the revolution to state building," he said. "I trust the national army. They have been with us on the frontline and I know them one by one. I don't need this weapon after today, the militias have been expelled from Benghazi and the national army will protect us."

Anger at the militias boiled over after the Sept. 11 attack on the U.S. consulate.

Most of Libya's militias emerged during the eight-month war against Gadhafi, but others sprang up after the end of fighting last October. With the country trying to rebuild after the 42-year dictatorship, the groups paid little attention to successive interim leaders. They were accused of bullying citizens, operating independent prisons and holding summary trials for Gadhafi loyalists. Recently, Islamist-led militias have also attacked shrines, such as tombs associated with religious figures they consider counter to their strict interpretation of Islam.

Last weekend, thousands of protesters marched against the militias in Benghazi, the cradle of the uprising against Gadhafi, and stormed two of their compounds.

In Tripoli, at least 200 former fighters handed over their weapons, including two tanks, at the Martyrs' square in the city center. A cleric urged young fighters to give up their weapons. "The nation is built with knowledge not guns," he said standing in the square.

Adversity Can Teach You Time Management

How well are you managing the time in your business? I know this isn't the most interesting topic in the world, but over the past 2 days, I've noticed something rather interesting. Now that I am back in school, taking 3 college course, I've been able to get more work done, in a lesser amount of time than when I wasn't in school. Not only am I getting things done more quickly, but I also have more time in my day to lounge around.

Prior to school starting up, all I had to do was lift weights and Internet Marketing, which would normally take me an entire day to do.

  • This usually meant writing a couples articles a day.
  • Doing some offsite marketing,
  • And maybe making a video or two.

Now that I'm in school, I'm doing the same amount of work, but finishing in less time.

  • I'm doing Internet Marketing,
  • Lifting weights,
  • And again, am now taking 3 college courses.

Yet, if I look at the clock right now, as I'm writing, it's only 9:37 AM. I've already written a blog post, am working on this article, and my bet is, by 10:30 AM, I'll be completely done with my Internet Marketing work for the day.

Something that usually takes me all day, I've managed to complete in approximately 2.5 hours. From 8:00 AM, which is when I went to the gym, to 10:30 AM, which is when I'm estimated to finish all of my work.

The reason why I'm telling you this is because I've noticed that in times of adversity; In times where it seems like there would be no way for me to get all of my work done, I somehow manage to make it happen. Lately, I've managed to not only make it happen, but I've managed to get more work done more quickly than when I had less work.

  1. Right now, I want you to sit down, and I want you to prioritize.
  2. I want you to setup a time box.
  3. How long should it take you to complete each task?
  4. If you were on a time crunch, could you complete a task that much more quickly?

If you're like me, you will find a way to complete more work in less time. Had I known this back in the summer, I would have enjoyed it that much more, by putting myself out there. Now that I know what I know, I don't see myself ever going back to the way things were before.

Kelly Exeter writes on News.com.au that this simple rule has saved her from spending large chunks of time battling piles (piles of clothing, piles of paper, piles of magazines). It takes less than a minute to file a bill you just paid, put a read newspaper in the recycling bin, or hang up an article of clothing.

Having one-minute cleaning accessories at hand also helps. For example, cleaning wipes at the bathroom sink and a trash can for junk mail by your front door.

This is like David Allen's Getting Things Done rule for dealing with tasks, except applied to housekeeping. If you want to get even more chores done, try the eight-minute rule for chores.

US officials explain Libya attack intelligence

(AP) ? U.S. intelligence officials sought to explain Friday why the Obama administration's understanding of the Sept. 11 attack on the U.S. Consulate in Benghazi is "evolving."

Facing a barrage of Republican criticism about what the administration knew and when about the attack, the Office of the Director of National Intelligence issued a statement Friday that laid out how officials came to understand the assault that killed U.S. Ambassador Chris Stevens and three other Americans. At the same time, the U.S. ambassador to the United Nations issued a statement explaining her early descriptions of the attack.

In the days immediately after the attack, the administration said it believed it was a spontaneous reaction to an anti-Islamic video that ridiculed Islam's Prophet Muhammad and ignited mob protests on U.S. embassies around the Middle East and in North Africa. Now, the administration has begun to call it a terrorist attack carried out by al-Qaida-linked militants and explain that it was a planned attack distinct from the mob protests in the region.

Republicans have seized on the Obama administration's changing narrative, saying the administration was too slow to label it a terrorist attack because, they said, the White House did not want to admit its policies had failed to defeat al-Qaida, and quell anti-American sentiment in the Muslim world.

"Throughout our investigation we continued to emphasize that information gathered was preliminary and evolving," DNI spokesman Shawn Turner's statement said.

"It remains unclear if any group or person exercised overall command and control of the attack, and if extremist group leaders directed their members to participate. However, we do assess that some of those involved were linked to groups affiliated with, or sympathetic to al-Qaida," he said.

At the same time, a spokeswoman for U.N. Ambassador Susan Rice also sought to explain comments that Rice made early in the investigation saying there was no evidence the Benghazi attack was premeditated.

"During her appearances on the Sunday talk shows Sept. 16, 2012, Ambassador Rice's comments were prefaced at every turn with a clear statement that an FBI investigation was under way that would provide the definitive accounting of the events that took place in Benghazi," said Erin Pelton, spokeswoman for the U.S. Mission to the United Nations. "At every turn Ambassador Rice provided ? and said she was providing ? the best information and the best assessment that the administration had at the time, based on what was provided to Ambassador Rice and other senior U.S. officials by the U.S. intelligence community."

Further intelligence may be slow to arrive. The FBI team that arrived in Libya last week to investigate the incident can't get to the scene of the attack because it is too dangerous, according to two law enforcement officials. The officials requested anonymity because they are not authorized to speak publicly about an ongoing investigation.

Republicans have seen the Libya attack as an opportunity to attack President Barack Obama on one of his strengths, foreign policy.

Rep. Peter King, the New York Republican who chairs the House Homeland Security Committee, said on CNN that Rice's explanation on the talk shows was "such a failure of foreign policy message and leadership" and "such a misstatement of facts" that "I believe she should resign."

In response, Sen. John Kerry, D-Mass., chairman of the Senate Foreign Relations Committee, said in a statement he was "deeply disturbed by efforts to find the politics instead of finding the facts in this debate." He called Rice "an enormously capable person."

GOP presidential nominee Mitt Romney accused the administration of being dishonest.

"I think it's pretty clear that they haven't wanted to level with the American people. We expect candor from the president and transparency," Romney told Fox News this week.

Recent intelligence reports indicated a force of more than 50 heavily armed extremists attacked the consulate, using gun trucks for added firepower, and establishing a perimeter to limit access to the compound and catch any Americans who might try to escape. A first wave of attacks set fire to the main building, forcing the Americans to flee to a fallback building a half mile away, where a second group of extremists attacked with mortar fire. Stevens died of apparent smoke inhalation when he was caught inside the main consulate building, becoming separated from the other fleeing diplomats.

Intelligence officials have focused their attention on Ansar al-Shariah, a Libyan militant group led by a former detainee at the U.S. military-run prison in Guantanamo Bay, Cuba.

Gen. Martin Dempsey, chairman of the Joint Chiefs of Staff, said Thursday that there has been a "thread of intelligence reporting" about groups in eastern Libya trying to coalesce but no specific threat to the consulate.

This 1964 Ford Mustang Ad Could Not Possibly Be More Boring I've been effusive in my praise of the first-gen Mustang in previous posts. I think it fully deserves the credit. The original Mustang was one of the most important cars ever made, and its design still looks great today. The baby boomer generation must have seen it as sex on wheels compared to the hulking, staid sedans their parents drove.

So how do you sell the Mustang to young people? Simple: you make the most boring commercial you possibly can. Wait, what?

That's exactly the approach Ford took when they made this ad, and it is quite possibly the most boring ad for a sporty car that I have ever seen. We see a young-ish stylist slaving over blueprints, striving to give the car a look of "total performance." Then the narrator goes on and on about the padded instrument panel, the sculpted side panels, the round rear openings and BLAH BLAH BLAH.

Get to the point, skip. I want to hear about engines and horsepower quotes. I want to see the car driving really fast. I want to see the driver actually having fun!

Oh look, it's driving next to some horses. I think I just fell asleep in my cereal bowl.

Luckily, Ford didn't need great ads for the Mustang to be a hit. The car started a revolution almost overnight, and for that, we're all better off. All I know is that Don Draper wouldn't have signed off on this ad. Way too boring.

Update: As a few of you astute folks have pointed out in the comments, this may have been a dealer training film rather than a TV ad. Good eye! But it's still boring. Really, really boring.

I started off this TV Club hoping that Season 3 of Louie would be ?as loose and weird and ambitious and tonally uneven and emotionally dead-on as ever.? Thirteen shows later, knowing now that Louis C.K. and some version of his crew flew all the way to China for what amounted to, at best, one-fourth of one episode of half-hour television, the ?as ever? part seems absurdly quaint. Perplexing, heartbreaking, hilarious, bizarre, a little lost, a little sexist?this season was, in the immortal words of Superchunk, ?everything at once.?

Last night?s finale was all that, including, despite both David and Jonah?s beautiful assessments, a little disappointing. The opener, with Louie slouched and forlorn on his couch as the camera pulls back to reveal Lilly and Jane tearing open their Christmas presents with delight, and then flashing back to reveal the hell that Louie went through to create that delight, was pretty much perfect. Jonah said it better than I ever could: Sweating, and ultimately sobbing, over a fucker of a doll in order to make your kid happy/shield her from unhappiness, is not going above and beyond?it?s being a parent. (Please direct all complaints about over-parenting philosophies to the comments, thank you.)

The elevator family tableaux hit me much harder than Liz?s death (which I thought C.K. kinda screwed up by cutting so obviously to the hospital?s New Year?s Eve cheer). Being alone is one thing?being left alone, as your family shoots down an elevator shaft and off on a two-week vacation with Patrick, seems much worse. To know what having a family is, and then to not have it all the time, and then to watch some other guy have it?this is the kind of stuff I have nightmares about.

Whether Louie was searching for a mate, a friend, or his runaway (well, closeted) daughter, most of this season was, in some form, about Louie not wanting to be alone. He may have stolen a boat in order to not reunite with his father, but all that did was leave him more adrift. Even the three-episode ?Late Night? arc feels, in hindsight, like an attempt to let Louie finally commit, and hopefully marry, his career. The finale addressed Louie?s fear?and reality?of loneliness head-on, with those awesomely named local news anchors taunting Louie from behind the TV screen.

Jonah, I wish I saw in that final scene what you saw?camaraderie, community, Louie feeling not so alone. You must have turned off the episode smiling. Instead, I saw a stupid American pronouncing Chinese funny, trying to make his hosts laugh on command, as if performing for Jack Dall. And I saw C.K. (lovingly) condescend to another culture, as he did in the Ramon episode: If colorful Latinos really know how to live, Chinese villagers understand the meaning of life.

But, hey, no hard feelings. I don?t know what in this episode, or season for that matter was real, what was a dream, and what was whatever the third choice would be?and it really doesn?t much matter. Like Louie arriving at the mighty Yangtze only to find a tiny stream but a tiny stream surrounded by gorgeous landscape but gorgeous landscape in the middle of one of the most populated cities in the world and that city being utterly foreign and yet kind of familiar and way better than being in Mexico with your brother-in-law, I?ll suck up the disorientation, embrace the emotion, and rationalize the let-downs of whatever the hell all that was.

Bioengineers introduce 'Bi-Fi' -- The biological 'Internet'

ScienceDaily (Sep. 27, 2012) ? If you were a bacterium, the virus M13 might seem innocuous enough. It insinuates more than it invades, setting up shop like a freeloading houseguest, not a killer. Once inside it makes itself at home, eating your food, texting indiscriminately. Recently, however, bioengineers at Stanford University have given M13 a bit of a makeover.

The researchers, Monica Ortiz, a doctoral candidate in bioengineering, and Drew Endy, PhD, an assistant professor of bioengineering, have parasitized the parasite and harnessed M13's key attributes -- its non-lethality and its ability to package and broadcast arbitrary DNA strands -- to create what might be termed the biological Internet, or "Bi-Fi." Their findings were published online Sept. 7 in the Journal of Biological Engineering.

Using the virus, Ortiz and Endy have created a biological mechanism to send genetic messages from cell to cell. The system greatly increases the complexity and amount of data that can be communicated between cells and could lead to greater control of biological functions within cell communities. The advance could prove a boon to bioengineers looking to create complex, multicellular communities that work in concert to accomplish important biological functions.

Medium and message

M13 is a packager of genetic messages. It reproduces within its host, taking strands of DNA -- strands that engineers can control -- wrapping them up one by one and sending them out encapsulated within proteins produced by M13 that can infect other cells. Once inside the new hosts, they release the packaged DNA message.

The M13-based system is essentially a communication channel. It acts like a wireless Internet connection that enables cells to send or receive messages, but it does not care what secrets the transmitted messages contain.

"Effectively, we've separated the message from the channel. We can now send any DNA message we want to specific cells within a complex microbial community," said Ortiz, the first author of the study.

It is well-known that cells naturally use various mechanisms, including chemicals, to communicate, but such messaging can be extremely limited in both complexity and bandwidth. Simple chemical signals are typically both message and messenger -- two functions that cannot be separated.

"If your network connection is based on sugar then your messages are limited to 'more sugar,' 'less sugar,' or 'no sugar'" explained Endy.

Cells engineered with M13 can be programmed to communicate in much more complex, powerful ways than ever before. The possible messages are limited only by what can be encoded in DNA and thus can include any sort of genetic instruction: start growing, stop growing, come closer, swim away, produce insulin and so forth.

Rates and ranges

In harnessing DNA for cell-cell messaging the researchers have also greatly increased the amount of data they can transmit at any one time. In digital terms, they have increased the bit rate of their system. The largest DNA strand M13 is known to have packaged includes more than 40,000 base pairs. Base pairs, like 1s and 0s in digital encoding, are the basic building blocks of genetic data. Most genetic messages of interest in bioengineering range from several hundred to many thousand base pairs.

Ortiz was even able to broadcast her genetic messages between cells separated by a gelatinous medium at a distance of greater than 7 centimeters.

"That's very long-range communication, cellularly speaking," she said.

Down the road, the biological Internet could lead to biosynthetic factories in which huge masses of microbes collaborate to make more complicated fuels, pharmaceuticals and other useful chemicals. With improvements, the engineers say, their cell-cell communication platform might someday allow more complex three-dimensional programming of cellular systems, including the regeneration of tissue or organs.

"The ability to communicate 'arbitrary' messages is a fundamental leap -- from just a signal-and-response relationship to a true language of interaction," said Radhika Nagpal, professor of computer science at the Wyss Institute for Biologically Inspired Engineering at Harvard University, who was not involved in the research. "Orchestrating the cooperation of cells to form artificial tissues, or even artificial organisms is just one possibility. This opens a door to new biological systems and solving problems that have no direct analog in nature."

Ortiz added: "The biological Internet is in its very earliest stages. When the information Internet was first introduced in the 1970s, it would have been hard to imagine the myriad uses it sees today, so there's no telling all the places this new work might lead."

Mexico catches Zetas drug capo 'El Taliban'

MEXICO CITY (AP) ? Mexico appeared to strike a major blow against one faction of the hyper-violent Zetas cartel, with the navy announcing it has captured one of the country's most-wanted drug traffickers, Ivan Velazquez Caballero, known as "El Taliban."

Velazquez Caballero has been fighting a bloody internal battle with top Zetas' leader Miguel Angel Trevino Morales, and officials have said the split was behind a recent surge in massacres and shootouts, particularly in northern Mexico.

"A person who is presumed to be, and acknowledges being, Ivan Velazquez Caballero, was captured in the state of San Luis Potosi" in north-central Mexico, the navy said in a statement on Wednesday.

Officials were presenting Velazquez Caballero to the media Thursday morning.

Also known as "Z-50," Velazquez Caballero has a 30 million peso ($2.3 million) reward on his head.

If confirmed, Velazquez Caballero's arrest could calm some of the brutal violence that has hit border cities like Nuevo Laredo, across from Laredo, Texas, in recent weeks.

On Sept. 14, eight men were found shot to death and one hanging from a bridge in Nuevo Laredo, territory traditionally controlled by Trevino Morales, alias "Z-40." Analysts say 14 bullet-ridden bodies stuffed in a van in mid-August in San Luis Potosi were men loyal to "El Taliban," and may have been left there as a warning by Trevino Morales' underlings.

Discussing recent fighting, a U.S. official in Mexico who could not be named for security reason said earlier this week that "I think right now the uptick that I'm seeing is between '40' and '50'," referring to Trevino Morales and Velazquez Caballero by their "Z'' aliases.

The Zetas cartel takes its name from a police radio code in which "Z'' means "commander," and a number refers to rank.

The official said Velazquez Caballero appeared to have formed an alliance of convenience with the Knights Templar cartel based in southern Michoacan state for his fight with Trevino Morales.

Banners signed by various elements of the Zetas and hung from overpasses in several Mexican states appeared to confirm mutual hatred between Trevino Morales and Velazquez Caballero. In the obscenity-laden banners, the two capos accused each other of betraying their fellow traffickers and preying on civilians.

If the man arrested as "El Taliban" is confirmed, the development could strengthen Trevino Morales, who shares leadership of the Zetas with Heriberto Lazcano, alias "El Lazca."

The U.S. official played down recent speculation that Trevino Morales and Lazcano had also fallen out.

"I'm not familiar with a fight between him (Trevino Morales) and Lazca," the official said. "I think he and Lazca ? Lazca is doing his thing and he is doing his, and they're still together from what I understand."

Lawmen and even competing drug capos picture Trevino as a brutal assassin who favors getting rid of foes by stuffing them into oil drums, dousing them with gasoline and setting them on fire, a practice known as a "guiso," a Spanish word for "stew."

The Zetas are already considered the hemisphere's most violent criminal organization. They have been blamed for a large share of the tens of thousands of deaths in Mexico's war on drugs, though other gangs also have repeatedly committed mass slayings.

Running gun battles between Navy personnel and gunmen broke out late Wednesday in the border city of Piedras Negras, across the border from Eagle Pass, Texas.

Officials in the border state of Coahuila confirmed the shootouts, and state security spokesman Sergio Cisbeles said the confrontation was serious, but he could not immediately confirm whether there anyone was wounded or dead.

The Zetas have been known to be active in Coahuila state, but it was unclear whether the confrontations in Piedras Negras were related in any way to the capture of Velazquez Caballero.

Home Automation | The Daily Omnivore

Home automation?(also called domotics) is the residential extension of ?building automation? (electronic which monitor and control the mechanical, electronics, and lighting systems in a building). ?Building Automation Systems? (BAS) keep the building climate within a specified range, provides lighting based on an occupancy schedule, and monitors system performance and device failures and provides email and/or text notifications to building staff.?Home automation may include centralized control of lighting, HVAC (heating, ventilation and air conditioning), appliances, and other systems, to provide improved convenience, comfort, energy efficiency, and security. Home automation for the elderly and disabled can provide increased quality of life for persons who might otherwise require caregivers or institutional care.

A home automation system integrates devices in a house with each other systems devoted to entertainment, houseplant and yard watering, pet feeding, changing the ambiance ?scenes? for different events (such as dinners or parties), and the use of domestic robots. Devices may be connected through a network to allow control by a personal computer, and remote access from the internet. Automated homes of the future have been staple exhibits for World?s Fairs and popular backgrounds in science fiction. However, problems with complexity, competition between vendors, multiple incompatible standards, and the resulting expense have limited the penetration of home automation to homes of the wealthy, or ambitious hobbyists. Possibly the first ?home computer? was an experimental home automation system in 1966.

In modern construction in industrialized nations, most homes have been wired for electrical power, telephones, TV outlets (cable or antenna), and a doorbell. Many household tasks were automated by the development of specialized appliances. For instance, automatic washing machines were developed to reduce the manual labor of cleaning clothes, and water heaters reduced the labor necessary for bathing. Other traditional household tasks, like food preservation and preparation have been automated in large extent by moving them into factory settings, with the development of pre-made, pre-packaged foods, and in some countries, such as the United States, increased reliance on commercial food preparation services, such as fast food restaurants. Volume production and the factory setting allows forms of automation that would be impractical or too costly in a home setting. Standardized foods enable possible further automation of handling the food within the home.

The use of gaseous or liquid fuels, and later the use of electricity enabled increased automation in heating, reducing the labor necessary to manually refuel heaters and stoves. Development of thermostats allowed more automated control of heating, and later cooling. As the number of controllable devices in the home rises, interconnection and communication becomes a useful and desirable feature. For example, a furnace can send an alert message when it needs cleaning, or a refrigerator when it needs service. Rooms will become ?intelligent? and will send signals to the controller when someone enters. If no one is supposed to be home and the alarm system is set, the system could call the owner, or the neighbors, or an emergency number.

In simple installations, domotics may be as straightforward as turning on the lights when a person enters the room. In advanced installations, rooms can sense not only the presence of a person inside but know who that person is and perhaps set appropriate lighting, temperature, music levels or television channels, taking into account the day of the week, the time of day, and other factors. Other automated tasks may include setting the HVAC to an energy saving setting when the house is unoccupied, and restoring the normal setting when an occupant is about to return. More sophisticated systems can maintain an inventory of products, recording their usage through bar codes, or an RFID tag, and prepare a shopping list or even automatically order replacements.

Home automation can also provide a remote interface to home appliances or the automation system itself, via telephone line, wireless transmission, or the internet, to provide control and monitoring via a smartphone or web browser. An example of remote monitoring in home automation could be triggered when a smoke detector detects a fire or smoke condition, causing all lights in the house to blink to alert any occupants of the house to the possible emergency. If the house is equipped with a home theater, a home automation system can shut down all audio and video components to avoid distractions, or make an audible announcement. The system could also call the home owner on their mobile phone to alert them, or call the fire department or alarm monitoring company.

In terms of lighting control, it is possible to save energy when installing various products. Simple functions such as motion sensors and detectors integrated into a relatively simple home automation system can save hours of wasted energy in both residential and commercial applications. For example imagine an auto on/off at night time in all major city office buildings, say after 10pm. When no motion is detected, lights shut down, and the owner could save kilowatts of wasted overnight energy. Similar controls on HVAC in buildings could save even more energy.

Home automation has been a feature of science fiction writing for many years, but has only become practical since the early 20th Century following the widespread introduction of electricity into the home, and the rapid advancement of information technology. Early remote control devices began to emerge in the late 1800s. For example, Nikola Tesla patented an idea for the remote control of vessels and vehicles in 1898. The emergence of electrical home appliances began between 1915 and 1920; the decline in domestic servants meant that households needed cheap, mechanical replacements. Domestic electricity supply, however, was still in its infancy ? meaning this luxury was afforded only the more affluent households.

Ideas similar to modern home automation systems originated during the World?s Fairs of the 1930s. Fairs in Chicago (1934), New York (1939) and (1964?65), depicted electrified and automated homes. In 1966 Jim Sutherland, an engineer working for Westinghouse Electric, developed a home automation system called ?ECHO IV?; this was a private project and never commercialized. The first ?wired homes? were built by American hobbyists during the 1960s, but were limited by the technology of the times. The term ?smart house? was first coined by the American Association of Housebuilders in 1984.?With the invention of the microcontroller, the cost of electronic control fell rapidly. Remote and intelligent control technologies were adopted by the building services industry and appliance manufacturers worldwide.

During the 90s home automation rose to prominence. By the end of the decade, ?domotics? was commonly used to describe any system in which informatics (the study of computer-based information systems) and telematics (telecommunications and informatics) were combined to support activities in the home. The phrase appears to be a portmanteau word formed from ?domus? (Latin: ?house?) and ?informatics,? and therefore refers specifically to the application of computer and robot technologies to domestic appliances. However, despite interest, by the end of the 1990s there was not a widespread uptake ? with such systems still considered the domain of hobbyists or the rich. The lack of a single, simplified, protocol and high cost of entry put off consumers.

There have been many attempts to standardize the forms of hardware, electronic and communication interfaces needed to construct a home automation system. Some standards use additional communication and control wiring, some embed signals in the existing power circuit of the house, some use radio frequency (RF) signals, and some use a combination of several methods. Control wiring is hardest to retrofit into an existing house. Some appliances include a USB port that is used for control and connection to a domotics network. Protocol bridges translate information from one standard to another, e.g., from X10 to European Installation Bus.

Besides the upcoming standardization of home automation hardware, there is also the issue of the control software. In older systems (and some contemporary ones), the control of each home automation system needed to be done separately, and there was thus no central control system. This sometimes led to a great amount of remote controls, one being needed to control each individual part of the system. However, with the new generation of home automation systems, central control can be foreseen. Software such as ?Fast Track Team Home Personality Software Greeter 1.0? (aka ?Cleopatra?) or ?e-Home Automation? route all?controllers?to a single computer, smartphone, or TV.

Heating, Ventilation and Air Conditioning (HVAC) solutions can include temperature and humidity control, and more commonly in Europe, fresh air, heating and natural cooling. Home automation solutions are varied and could include an internet-controlled thermostat, by allowing the homeowner to control the building?s heating and air conditioning systems remotely, or it could be linked to windows to allow automated opening and closing to allow hot air out and cool air in to allow for cooling of the thermal mass of the house structure. Many systems are designed to not only provide convenience but to also allow for better energy efficiency.

Lighting control systems can do things like:?extinguish all the lights of the house at a predetermined time and date range;?use motion detectors to automatically extinguish the lights in a room after occupants have left and turn on the lights if occupants enter a room;?turn the light on or off with the use of a remote wireless device; control the brightness of the lights according to the level of ambient light available, or other criteria; and change the ambient?color?of a room via the lights used or by using RGB LEDs (mood control). Natural lighting control involves controlling window shades, LCD shades, draperies, and awnings.

With Home Automation, the consumer can select and watch cameras live from an Internet source to their home or business. Security cameras can be controlled, allowing the user to observe activity around a house or business right from a Monitor or touch panel. Security systems can include motion sensors that will detect any kind of unauthorized movement and notify the user through the security system or via cell phone. Systems devoted to home security include: intrusion detection; motion sensors; magnetic contact sensors for doors / windows; glass break detectors; pressure sensors; presence simulation; detection of fire, gas leaks and water leaks; and medical alert (teleassistance).?An intercom system allows communication via a microphone and loud speaker between multiple rooms. Integration of the intercom to the telephone, or of the video door entry system to the television set, allowing the residents to view the door camera automatically.

Other systems that can be tied into home automation include security gates, garage door,?coffee machine, pool/hot tub, sump pump, and well pump.

Home automation technologies are viewed as integral additions to the ?Smart grid.? The ability to control lighting, appliances, HVAC as well as Smart Grid applications (load shedding, demand response, real-time power usage, and price reporting) will become vital as Smart Grid initiatives are rolled out. Green Automation is the term coined to describe energy management strategies in home automation when data from smart grids is combined with home automation systems to use resources at either their lowest prices or highest availability, taking advantage, for instance, of high solar panel output in the middle of the day to automatically run washing machines.

Kids from the ages of 2 to 19, consume about 7 trillion calories in sugar-sweetened beverages per year, according to Steve Gortmaker of the Harvard School of Public Health. He spoke at the Obesity Society Annual Scientific Meeting in San Antonio on September 23rd.? Seven trillion is a lot of calories in sugar-sweetened beverages. At, for example, 50 cents per can, it's about $24 billion a year.

All of those dollars and sugary calories are stoking the childhood obesity epidemic. Currently, in the U.S., about 17 percent of children and adolescents are obese?that's more than 12.5 million kids. And new research in the British Medical Journal suggests that obese children will have much higher risk factors for cardiovascular disease as adults. [Claire Friedemann, et al, Cardiovascular Disease Risk In Healthy Children And Its Association With Body Mass Index: Systematic review and meta-analysis] Even as kids, their hearts are changing shape to look like those of adults at risk for heart disease.

But the good news is that simply cutting out an average of 64 calories a day from kids' diets could start to level out the steep rise in childhood obesity. That's equivalent to less than half a can of most non-diet sodas.

A Clever Use of Direct Mail to Re-Connect With Email Subscribers ...

Remember when you were a child and getting mail was something to be excited about?

You?d see your name on the envelope and wonder what was inside.

But alas, you grew up and now know exactly what?s inside? bills, statements and junk mail.

The illusion is gone and opening mail ? well it?s no longer fun. In fact most of us have trained ourselves to throw non-personal mail straight in the bin without even looking to see who it?s from.

With that in mind, some of you might be wondering if integrating direct mail campaigns with your email marketing is a thing of the past. After all, direct mail is rather expensive compared to email.

What can it possibly have to offer your email marketing strategy?

Well one thing is an alternative communication method for reaching bounced email subscribers. Take a look at this direct mail campaign that recently arrived in my letterbox as an example.

First let me explain that my wife is quite the enthusiast when it comes to online shopping. So I didn?t think twice when I saw this missing delivery notice in my letterbox.

I simply placed it on the kitchen bench for her thinking that it must be something important. But then I flipped it over and realised that the missed delivery was actually referring to a bounced email message.

Direct Mail - Back

Now as a marketer I thought this was very clever. And it goes to show how much value Woolworths place on their customer?s email addresses. Direct mail campaigns aren?t cheap after all.

Let?s look at what makes this direct mail campaign so great and what us email marketers can learn from it.

1. It?s well designed. Let?s be honest? most mail that arrives from companies goes straight in the bin. So designing this card to look like a missed delivery slip is genius and is sure to make even the most cynical consumer (like myself) look twice before throwing it away. The same applies to email. A well designed email captures the reader?s attention and draws them towards the key content, offer and call to action.

2. It?s personal. More than addressing the recipient by name, it also delivers a personal and powerful message. This captures your attention and entices you to turn the card over to find out more. The ability to personalise messages is also one of the strengths of email marketing. Personalised content holds a lot more relevance for readers and is much more likely to drive action.

3. Provides clear instructions. This campaign carries with it a very simple and single minded instruction to update your email address. And because it?s the only call to action, there is less distractions for the reader and more chance they will do it. This is a great tip for email marketers because it shows that a single, well communicated call to action can get better results than multiple call to actions.

4. Reminds you of the benefits. Regardless of the type of campaign, if you expect people to act you need to give them a reason. And the best way to do this is to by explaining what?s in it for them. What this direct mail campaign does particularly well is position the reminder directly next to the call to action. With email, positioning is arguably even more important as readers have limited space on their screens and will often need to scroll to see your message in full. So be sure to place your most important content towards the top of your email and consider how it might be viewed on different devices.

There you have it. What a great way to re-connect with bounced email subscribers in an attempt to bring them back into your email program. Dell's Latitude 10, the ASUS Tablet 810, Acer's Iconia W510 and W700, Lenovo's ThinkPad 2, the HP Envy x2 and Samsung's Series 5 were all there. However, it was the handsome slice of Windows 8 from ZTE that really caught our attention. Called the V98, it has a 10.1-inch, 1366 x 768 LCD on top of an aluminum chassis with a beveled edge similar to what you'd find on a white iPhone 5. Beneath that handsome exterior is the aforementioned Intel Z2760 chipset, 64GB of ROM, 2GB of RAM and 32GB of storage (plus a microSD slot if you need more digital space). There's 802.11 b/g/n WiFi, GPS, Bluetooth 4.0, tri-band UMTS and quad-band GSM radios, plus NFC and LTE can be had as options. It's got an accelerometer, proximity and ambient light sensors, a magnetometer and a gyro, too. An 8-megapixel camera is stuck in the back, while a 2-megapixel shooter resides round front. ZTE managed to stuff all that and a 7,000mAh battery inside a svelte 8.9mm-thin package.

We got to spend a little bit of time with a prototype ZTE model, and found the hardware to be solid for a hand-built unit. Its aluminum chassis makes for quite a rigid device in hand, and the machined and polished bevel gives the V98 a very high-end look. The chromed plastic volume rocker, power button and screen orientation lock switch nestled in the plastic radio reception strip at the top of the device are decidedly less luxurious, however -- the travel of each was shallow, and the finish on the plastic appeared a bit cheap to our eyes. That said, the rotating magnetic aluminum door that reveals the SD card and SIM slots is slick -- far easier to open and close than the plastic port covers found on most other slates. There's also a 30-pin docking port on the bottom edge of the tablet, but ZTE informed us it'd be another month or so before the dock is ready for public consumption. Unfortunately, the V98 won't be available for purchase until Q1 of next year, but you can see if its worth waiting for in our gallery of shots below.

By outfitting two British Columbia subspecies of Swainson's thrushes with penny-sized, state-of-the-art geolocators, University of British Columbia researchers have been able to map their wildly divergent migration routes and pinpoint conservation hotspots.

"Birds of a feather do not necessarily flock together," says Kira Delmore, a PhD student with UBC's Department of Zoology and lead author of the paper. "Our teams of thrushes took dramatically different routes to get to their wintering grounds, either south along the west coast to Central America, or southeast to Alabama and across the Gulf of Mexico to Columbia."

The study, to be published this week in the Proceedings of the Royal Society of London B, is the first to collect a complete year's worth of data from individual birds to document such a migratory divide.

"This detailed level of migration and stopover data helps us pinpoint vital feeding and rest habitats that the birds rely on at key points during their long journey ? just before crossing the Gulf of Mexico, for example," Delmore adds.

The researchers say the study also raises the possibility that migratory behavior may play a role in speciation, the process by which one species evolves into two.

"Given that migratory behavior is under genetic influence in many species of birds, these results raise the question of what hybrids between these two subspecies would do," says Darren Irwin, associate professor of Zoology at UBC and co-author of the paper. "One possibility is that hybrids would take an intermediate route, leading to more difficulties during migration. If so, the migratory differences might be preventing the two forms from blending into one."

About Swainson's thrushes

Swainson's thrushes, with olive-brown feathers, lighter mottled undersides, and distinct light eye-rings, are typically 16 to 20 centimetres (seven inches) in length with a wingspan of 30 centimetres (one foot). They are not endangered.

Research methodology

UBC researchers caught 40 thrushes in June 2010 ? 20 each of a subspecies from Pacific Spirit Park near UBC in Vancouver and another from locations near Kamloops, B.C. The birds were lured into six-metre- wide mist nets with mating calls.

The geolocators used weigh 0.9 gram and with attachment materials they weight approximately four per cent of the body weight of a thrush. Researchers then attached the newly invented geolocation devices, which record sunrise and sunset times, on the birds with special harnesses before releasing them. To collect the data, Delmore undertook the process in reverse a year later.
