U.S. Army sergeant acquitted of negligent homicide in soldier's suicide

WINSTON-SALEM, North Carolina (Reuters) - A military jury found a U.S. Army sergeant not guilty on Monday of negligent homicide in the death of a Chinese-American soldier who officials say killed himself in Afghanistan after enduring hazing and racial slurs.

Sergeant Adam Holcomb, 30, was the first of eight soldiers from the 1st Brigade, 25th Infantry Division based in Alaska to face a court-martial in connection with Private Danny Chen's death in October 2011.

The military panel that heard Holcomb's case in Fort Bragg, North Carolina, found him guilty of maltreatment and assault, but acquitted him of both negligent homicide and harassment, base spokesman Thomas McCollum said.

The 10-member jury of officers and enlisted soldiers is set to recommend a sentence on Tuesday. Holcomb faces up to 2-1/2 years in prison, and the final decision on his punishment rests with the commander of the 18th Airborne Corps.

Chen, 19, killed himself by gunshot in a guard tower in southern Afghanistan, where military prosecutors said the weeks of physical mistreatment and racial prejudice he encountered from his superiors pushed him to take his own life.

Holcomb's attorneys argued that Chen committed suicide because he was struggling as an infantryman and had been disowned by his parents for joining the Army - a claim backed by fellow soldiers but denied by Chen's mother and father from the witness stand last week.

Chen, the only Chinese-American in his unit, was born in New York and raised in the city by his immigrant parents. The case prompted activists to call for more protections against abuse for Asian-American service members, who make up 4 percent of the active duty U.S. military.

Holcomb, who pleaded not guilty to all the charges, was accused of referring to Chen by racially derogatory names such as "dragon lady," "Jackie Chen" and "egg roll."

According to testimony, Holcomb also caused injuries to Chen's back by dragging him across gravel after the lower-ranked soldier left a water pump on in a shower at the remote combat outpost where Chen began his first deployment in August 2011.

A fellow soldier testified that in a separate incident hours before he killed himself, Chen was forced to crawl to a guard tower as punishment while several non-commissioned officers threw rocks at him and yelled, "Incoming!"

The New York chapter of the Organization of Chinese Americans, which represents Asian-Americans, on Monday called for Holcomb to receive the maximum punishment and a dishonorable discharge.

"There is no place in the Army for a leader who discriminates against a subordinate with such reckless disregard for human life," said Elizabeth OuYang, president of the organization.

Tech titans face off in court over iPhone, iPad

SAN FRANCISCO (AP) ? With billions of dollars and control of the U.S. smartphone and computer tablets markets at stake, jury selection began Monday in a closely watched trial between two of the world's leading tech companies over patents.

Apple Inc. filed a lawsuit against Samsung Electronics Co. last year alleging the world's largest technology company's smartphones and computer tablets are illegal knockoffs of its popular iPhone and iPad products.

Cupertino-based Apple is demanding $2.5 billion in damages, an award that would dwarf the largest patent-related verdict to date.

Samsung countered that Apple is doing the stealing and that some of the technology at issue ? such as the rounded rectangular designs of smartphones and tablets ? has been industry standards for years.

A jury of 10 people will be picked from a pool of dozens, and opening statements could start late Monday or early Tuesday in a trial expected to last more than a month.

The case is just the latest skirmish between the two companies over product designs. A similar trial began last week, and the two companies have been fighting in courts in the United Kingdom and Germany.

Industrywide, some 50 lawsuits have been filed by myriad telecommunications companies jockeying for position in the burgeoning $219 billion market for smartphones and computer tablets.

U.S. District Judge Lucy Koh in San Jose last month ordered Samsung to pull its Galaxy 10.1 computer tablet from the U.S. market pending the outcome of the upcoming trial, though the judge barred Apple attorneys from telling the jurors about the ban.

"That's a pretty strong statement from the judge and shows you what she thinks about some of Apple's claims," said Brian Love, a Santa Clara University law professor and patent expert. He said that even though the case will be decided by 10 jurors, the judge has the authority to overrule their decision if she thinks they got it wrong.

"In some sense the big part of the case is not Apple's demands for damages but whether Samsung gets to sell its products," said Mark A. Lemley, a Stanford Law School professor and director of the Stanford Program in Law, Science, and Technology.

Lemley said a verdict in Apple's favor could send a message to consumers that Android-based products such as Samsung's are in legal jeopardy. A verdict in Samsung's favor, especially if it prevails on its demands that Apple pay its asking price to certain transmission technology it controls, could lead to higher-priced Apple products.

Lemley and other legal observers say it's rare that a patent battle with so much at stake doesn't settle short of a trial. Court-ordered mediation sessions attended by Apple's chief executive Tim Cook and high-ranking Samsung officials failed to resolve the legal squabble, leading to a highly technical trial of mostly expert witnesses opining on patent laws and technology. Cook is not on the witness list and is not expected to testify.

Lemley, Love and others say it also appears that Apple was motivated to file the lawsuit, at least in part, by its late founder's public avowals that companies using Android to create smartphones and other products were brazenly stealing from Apple. To that end, Samsung's attorneys made an unsuccessful pitch to have the jury hear excerpts from Steve Jobs' authorized biography.

"I will spend my last dying breath if I need to, and I will spend every penny of Apple's $40 billion in the bank, to right this wrong, I'm going to destroy Android, because it's a stolen product," Jobs is quoted as saying in Walter Isaacson's book "Steve Jobs" published in November. "I'm willing to go thermonuclear war on this."

But the judge barred those statements in a ruling earlier this month.

"I really don't think this is a trial about Steve Jobs," Koh said.

In court papers filed last week, each company laid out its legal strategy in so-called trial briefs.

Apple lawyers argue there is almost no difference between Samsung's products and Apple's and that the South Korean company's internal documents show it copied Apple's iconic designs and its interface.

"Samsung once sold a range of phones and a tablet of its own design," Apple lawyers argue in their documents filed Wednesday. "Now Samsung's mobile devices not only look like Apple's iPhone and iPad, they use Apple's patented software features to interact with the user."

Samsung denies the allegation and counter-claims that Apple copied its iconic iPhone from Sony. Samsung lawyers noted the company has been developing mobile phones since 1991 and that Apple jumped into the market in 2007.

"In this lawsuit, Apple seeks to stifle legitimate competition and limit consumer choice to maintain its historically exorbitant profits," Samsung lawyers wrote in their trial brief also filed Wednesday. "Android phones manufactured by Samsung and other companies ? all of which Apple has also serially sued in numerous forums worldwide ? offer consumers a more flexible, open operating system with greater product choices at a variety of price points as an alternative to Apple's single, expensive and closed-system devices."

"Between 2005 and 2010 alone, Samsung invested $35 billion in research and development relating to telecommunications technology, with over 20,000 engineers worldwide dedicated to telecommunications research and development," Samsung's lawyers wrote.

"One thing that is notable is that this trial is happening at all," said Love, the law professor and patent expert. He said that in an industry such as this where so many companies hold so many vital patents needed by all players, lawsuits are viewed as toying with "mutually assured destruction" and that most disputes are solved through "horse trading" and agreements to share intellectual property and royalties.

Mike Lehner said in a written statement, according to the Detroit Free Press.? ?She has rejected those attempts and has now filed a lawsuit against Mr. Suh asking for more than $1,000,000.? According to that lawsuit, she has incurred approximately $4,000 in medical expenses, and lost wages in the amount of $2500.? Mr. Suh denies many of the allegations in the complaint, but now it appears a jury will have to decide how to fairly compensate Ms. Van Winkle for her injury.?

Typically, a personal-injury case has a settlement value in the range of three times the amount of the so-called ?out-of-pocket? or ?special? damages.? The thinking is that, by using a specials-times-three formula, the bills get paid, the plaintiff gets an equivalent amount for pain and suffering, and the lawyer gets his/her cut.

Of course, a jury can award whatever it wants, subject to modification by the judge if the jury gives too much or too little.? Still, in this case, the settlement value would be in the range of $20,000, if Van Winkle?s injuries are fully resolved.

So, yes, a $1 million demand is excessive.? It therefore makes sense to take it to trial, especially since the legal fees and the settlement/verdict ultimately will be covered by Suh?s insurance policy ? assuming that he had one that was paid up and in place.

For his part, Suh declined to address the situation on Friday, referring all questions to his lawyers.? That?s the smart approach, because anything he says now can be used against him in court later.

Anti-nuclear protesters surround Japan parliament

Thousands of demonstrators holding aloft candles and lights formed a human chain around Japan's parliament on Sunday in a new protest against nuclear power after last year's Fukushima atomic crisis.

The sea of people illuminated the evening gloom as they surrounded the legislature in Tokyo, the latest development in a snowballing protest movement of the type not seen in sedate Japan for decades.

The protesters are demanding that Japan abandon nuclear power and their movement has been galvanised by Prime Minister Yoshihiko Noda's recent decision to resume using atomic energy after a total shutdown.

Organisers put the number of protesters at 200,000, but police told local media that there were between 10,000 and 20,000 people.

With many clad in gas masks and white protective suits similar to those used in decontamination work at the crippled Fukushima plant, the demonstrators earlier took part in a noisy march through the capital to the parliament.

To the noise of drumming on yellow barrels emblazoned with atomic waste warning symbols, they chanted "we don't need nuclear power" and "stop operating nuclear plants".

"After the Fukushima disaster, I thought that the government and vested interests were telling us lies about nuclear power being safe," said protester Miho Igarashi, 46, an architect from Ibaraki prefecture south of Fukushima.

"We have to raise our voices against" the danger of atomic power, she told AFP.

The rally is the latest in a string of protests in Japan, which has seen a rising tide of anti-nuclear sentiment since Noda in June ordered the restart of two reactors.

Noda defended the move citing looming power shortages after Japan switched off its 50 nuclear reactors -- which provided the resource-poor country with a third of its energy -- in the wake of the Fukushima disaster.

Weekly demonstrations outside the prime minister's residence have drawn tens of thousands of people and a rally in west Tokyo earlier this month saw a crowd that organisers claimed was about 170,000-strong.

The march earlier Sunday took place in high temperatures under a blazing sun, and the crowd included families with small children.

"I decided to join the protest because nuclear reactors are resuming even though their safety is not guaranteed," said Sayaka Suzuki, 28, who was with her three-year-old daughter.

The latest rally comes less than a week after a damning government-backed report on last year's crisis said Japanese officials and Tokyo Electric Power (TEPCO), operator of the crippled Fukushima plant, ignored the risk of an atomic accident because they believed in the "myth of nuclear safety".

A separate parliamentary report said the worst nuclear accident in a generation was a man-made disaster, marked by a lack of oversight and collusion between TEPCO, the government and regulators.

The giant utility largely cleared itself of blame, saying the size of last year's earthquake and tsunami was beyond all expectations and could not have reasonably been foreseen.

A 9.0-magnitude earthquake and tsunami on March 11, 2011, crippled cooling equipment at the Fukushima Daiichi plant, triggering meltdowns that spewed radioactivity and forced tens of thousands of residents to flee.

The rising anti-nuclear sentiment in Japan has also led to the launch of Greens Japan, a political organisation aiming to field candidates with an environmental agenda in parliamentary elections.

"A party that strongly pursues environmental policies is needed," Akira Miyabe, the group's 59-year-old deputy head, was quoted by Kyodo News as saying at an inaugural meeting on Saturday.

Searchers on Saturday found the bodies of two U.S. mountaineers who apparently plunged 1,000 feet to their deaths on their way down from the summit of a glacier-capped Peruvian peak.

Gil Weiss, 29, and Ben Horne, 32, fell off a ridge after reaching the west summit of 20,584-foot?Palcaraju in the Cordillera Blanca range in mid-July, search coordinator Ted Alexander told The Associated Press.

Their bodies will be recovered Sunday, he said.

Both Weiss, of Queens, N.Y., and Horne, of Annandale, Va., were experienced climbers. Weiss was a repeat visitor to the Cordillera Blanca while this trip was Horne's first.

Both belong to the pullharder.org climbers' collective, and Horne wrote about the first, six-day leg of their trip on its blog, saying they had been buffeted by hurricane-force winds when the two reached the top of the 20,216-foot Ranrapalca.

After a rest in Huaraz, the two set out again July 11 for an excursion of seven to 10 days. Their families contacted Alexander after 13 days passed with no word from them.

Weiss's sister, Galit, said the two were not carrying a satellite phone.

In the new study of adult mice, University of North Carolina researchers found evidence that the effects of the bath salt mephedrone on the brain's reward circuits are comparable to similar doses of cocaine.

The mice were implanted with brain-stimulating electrodes and trained to run on a wheel in order to give themselves a reward, which was direct stimulation of the brain pathways involved in reward perception.

The technique, called "intracranial self-stimulation" has been used in experiments since the 1950s, according to researchers. Prior intracranial self-stimulation studies have shown that one of the characteristics of addictive drugs is to make self-stimulation more pleasurable.

The researchers measured the rodents' wheel spinning efforts before, during and after they were given various doses of cocaine or mephedrone. Like cocaine, mephedrone made intracranial self-stimulation more rewarding for the mice.

The study was released online in advance of publication in an upcoming print issue of the journal Behavioural Brain Research.

The findings support the idea that mephedrone and other bath salts may have a significant addiction risk, said study leader Dr. C.J. Malanga, an associate professor of neurology, pediatrics and psychology at the University of North Carolina School of Medicine.

"The effects of mephedrone on the brain's reward circuits are comparable to similar doses of cocaine," Malanga said in a university news release. "As expected our research shows that mephedrone likely has significant abuse liability."

On July 9, President Barack Obama signed a law banning bath salts containing mephedrone or another stimulant, MDPV, in the United States.

Experts caution that while animal studies may be useful, they often don't reproduce the same results in humans.

Weight Control Can Cut Women's Diabetes Risk, Study Shows

FRIDAY, July 27 (HealthDay News) -- Weight control through diet and exercise can prevent most cases of type 2 diabetes in American women over age 50, a new study finds.

Researchers from the University of Massachusetts Medical School in Worcester, Mass., analyzed data from more than 150,000 postmenopausal women who were followed for more than 10 years. Hispanics and Asians were about twice as likely as whites to develop diabetes; blacks were two to three times as likely.

Those differences were largely due to modifiable lifestyle factors such as diet, physical activity and smoking, the researchers said.

The study also found that a large reduction in diabetes risk among women would occur in all four racial and ethnic groups if they maintained a healthy body weight, ate a healthy diet and were physically active.

Maintaining a body-mass index (BMI) of less than 25 appeared to be particularly important in reducing diabetes risk. BMI is a measure of body fat based on height and weight.

"Our work shows that among numerous races [and] ethnicities, the women with both high body-mass index and low levels of physical activity are far more likely to develop diabetes," primary investigator Dr. Yunsheng Ma said in a medical school news release. "A healthier diet and adequate levels of physical activity significantly lower that risk for most women."

The study was published July 23 in the journal Diabetes Care.

Type 2 diabetes, the more common type, means the body doesn't produce or properly use the hormone insulin, which is needed to convert food into energy. Untreated, type 2 diabetes can cause damage to the heart, eyes, kidneys and other organs.

Big asset managers miss Wall Streey views as investors flee

(Reuters) - Four of the largest U.S. money managers reported sharp declines in second-quarter earnings on Thursday, as volatile markets and fleeing customers cut into their fee income.

The decline was steepest at Denver-based Janus Capital Group Inc, which remains mired in a multiyear trend of lagging fund performance and customer withdrawals. The company's shares lost 2.6 percent on the New York Stock Exchange.

Net income of $23.4 million was down 44 percent from a year earlier. And the 13 cent per share profit was a penny less than analysts, on average, had expected according to Thomson Reuters I/B/E/S, due to higher-than-anticipated customer outflows of $3.9 billion from long-term funds.

"It looks pretty messy," said Sandler O'Neill analyst Michael Kim, who had expected outflows of about $2 billion.

Total assets under management at Janus fell to $152.4 billion on June 30, down 7 percent during the quarter and 10 percent from a year earlier.

Most of the industry fared poorly in one of the toughest quarters for money managers since the financial crisis ended. Beset by fears of debt defaults in Europe and an economic slowdown in the United States and China, investors drove the MSCI All Country Index down 6.4 percent in the second quarter while the Standard & Poor's 500 lost 2.8 percent.

And that prompted many investors to withdraw and wait for the chaos to subside, particularly from stock funds, the category that tends to provides the highest fees to managers.

"SHARP TURNAROUND"

That hit profits at Invesco Ltd, the largest manager reporting results on Thursday. Net income attributable to common shareholders declined 16 percent from a year earlier. Atlanta-based Invesco said its per-share profit adjusted to exclude some items was 41 cents, 2 cents less than analysts had expected.

During the quarter, customers yanked a total of $8.3 billion, including $4.9 billion from higher-fee, long-term funds, Invesco said. Assets under management at the end of the quarter totaled $646.6 billion, down 1 percent from a year ago.

"In this uncertain climate, investors naturally were seeking safe havens and acting defensively," Invesco Chief Executive Officer Martin Flanagan said on a call with analysts.

But in July, the company had a "sharp turnaround," Flanagan said, with customer inflows into various funds, including real estate, bank loans and international growth equity products.

"Frankly, you can see the end of the tunnel and, looking out to next year, a pretty good outlook," he said.

That helped rally Invesco shares, which closed up 2.1 percent on the New York Stock Exchange.

Invesco's second-quarter outflows were "not the end of the world given the company's solid and consistent performance records, (and) resilient investment management fees," Nomura analyst Glenn Schorr wrote in a note to investors.

Janus Chief Executive Officer Richard Weil struck a more pessimistic note on his call with analysts.

"With extreme market volatility and ... not such great results in equity markets more broadly, a lot of investors are scared, and they're either doing nothing, or pulling back from equities," Weil said.

Profits at smaller Waddell & Reed Financial, based in Overland Park, Kansas, dropped 17 percent to $41.7 million. Adjusted per-share profit of 52 cents matched the average analyts estimate.

Customers added to Waddell funds during the quarter, though at a slower pace than in the same quarter a year ago. Second-quarter inflows totaled $376 million, down from $1.7 billion a year earlier. Total assets declined 3 percent from last year to $89 billion. Shares gained 2.4 percent.

FEDERATED INVESTORS

At Pittsburgh-based Federated Investors, second-quarter profits dropped only 5 percent to $40.4 million. As one of the largest manager of U.S. money market funds, Federated had less to lose in the stock market turmoil.

Total assets of $355.9 billion as of June 30 included $265.5 billion of money market funds. Customers added $2 billion to long-term funds, Federated said.

Shares of Federated gained 1 percent during the day in trading on the New York Stock Exchange.

Overall, the reports were similar to competitor T. Rowe Price Group Inc's a day earlier. On Wednesday, T. Rowe reported slightly lower-than-expected quarterly earnings as well as outflows from institutional investors, but it had a net inflow of $4.7 billion overall, because retail customers put money into its funds.

And the world's largest asset manager, BlackRock Inc, said last week that its second-quarter profit dropped 11 percent. The $3.5 trillion firm said declining markets had cut $76.8 billion from the value of its assets in the second quarter. Still, BlackRock reported customers had added $3.8 billion to its funds.

BEIRUT (AP) ? Like other communities sucked into Syria's widening civil war, the Yarmouk neighborhood in Damascus has seen death and destruction. Soldiers and snipers have gunned down demonstrators. Some protesters have taken up arms to fight back.

But there's one key difference: Most of Yarmouk's residents are not Syrian citizens. They are Palestinian refugees.

Since the start of the unrest, Syria's half-million Palestinians have struggled to remain on the sidelines. They've said they have little to gain and much to lose by taking sides in the fight between President Bashar Assad's regime and the armed rebels seeking to end his family's four-decade rule.

But young Palestinian refugees, enraged by this month's mounting violence and moved by Arab Spring calls for greater freedoms, are now flooding the streets and even joining the rebels despite efforts by the community's political leadership to keep them out of the conflict.

Large protests began two weeks ago in the country's largest Palestinian refugee camp, Yarmouk, a neighborhood of nearly 150,000 refugees crowded into simple apartment buildings on narrow streets in the Syrian capital. Security forces fired on the protesters, killing at least five and setting off a cycle of funerals, demonstrations and further crackdowns.

On Thursday, activists said troops posted outside Yarmouk were shelling the area, likely in preparation for a raid.

"There are cars that have blown up and homes that have blown up," a Palestinian activist in Yarmouk who gave his name as Abu Omar said via Skype, booms audible in the background. "We are really in a war zone now."

Violence has struck other Palestinian camps too. More than two-thirds of the 17,500 refugees in the southern city of Daraa fled an attack this month, the U.N. said. While many have returned, food and medicine are lacking.

The U.N. says it cannot provide death tolls for Palestinians because of the difficulty of confirming information. The Britain-based Syrian Observatory for Human Rights estimates that about 150 have been killed since the uprising began in March 2011. Palestinian activists provided the names of 198 people killed, 67 in July alone.

Most of Syria's 496,000 U.N.-registered Palestinian refugees are descended from those who fled or were forced to leave their homes during the war surrounding Israel's creation in 1948. Others have come during subsequent Mideast wars.

While not citizens, Palestinians in Syria have greater rights than their brethren in other Arab countries. They can hold government jobs, attend state universities for free and serve in the military. Assad's regime has long billed itself as a champion of the Palestinian cause.

But the Syrian uprising, which began with political protests and has evolved into a civil war, has put the Palestinians in a bind. As the death toll spiraled, many were horrified by Assad's brutal attempts to crush the opposition but didn't want turn on a government that treated them well.

"On the individual level, there's no love for the regime or its tools of oppression, and no one thinks that it will liberate Palestine for us," said a Palestinian refugee expert in Lebanon who visited Syria this month. "The idea is that if we take a position on one side or the other, we'll get screwed."

He declined to give his name because he travels frequently to Syria.

The political leadership, dominated by older men from an array of Palestinian factions, recalls all too easily how Palestinians elsewhere have suffered for picking sides in foreign conflicts. Kuwait kicked out hundreds of thousands of Palestinians near the end of the first Gulf War because of their leadership's links to Saddam Hussein.

"I fear that in the next stage the camps and the youth will be pulled into the internal conflict," said Fathi Ardat, the Palestine Liberation Organization's top official in Lebanon. "We don't want to be part of that battle."

Some factions have cooled relations with Assad's regime.

Top Hamas officials have decamped from their longtime Damascus headquarters for Egypt and the Gulf. In a February sermon in Cairo, Ismail Haniyeh, the Hamas Prime Minister of Gaza, praised Syrians for "moving toward democracy and reform."

The only group firmly with the regime is the radical Popular Front for the Liberation of Palestine-General Command, which the U.S. and other countries consider a terrorist organization ? as they do Hamas. Its fighters are widely accused of joining Assad's forces in the crackdown.

To date, no Palestinian faction has denounced the regime, putting them at odds with Palestinian youth in Syria.

The forces pulling young Palestinians into the war grew stronger this month.

On July 11, the bodies of 15 soldiers from the Palestinian Liberation Army, a branch of the Syrian armed forces, were found outside of Aleppo, the country's largest city. There were conflicting accusations about who killed the soldiers, but many Palestinians blamed Assad's regime.

On July 13, hundreds of Palestinians protested in Yarmouk, accusing Assad's forces of killing the soldiers and calling for the regime's ouster because of its brutality toward other Syrians. Security forces opened fire on the crowd, according to amateur videos posted online, and activists say five people were killed.

Protests continued as rebels pushed into the capital from the countryside and clashed with security forces in surrounding neighborhoods, sending civilians streaming into the camp. The U.N. said this week that more than 7,000 displaced people were staying in 17 schools in Yarmouk.

On July 19, rebels ? including some Palestinians ? torched a police station on the camp's edge and a dozen security cars posted around it.

As violence entered the camp, more youth joined in.

"At first, most people said we won't interfere because this is a problem between Syrians," said Mohammed, a refugee from Yarmouk who now lives in Britain. "Later, more said it was about freedom, so it doesn't matter where you're from."

While most have avoided arms, some Palestinians have joined the rebels in battle.

"They have taken a position with the revolution, but they have not made this public because that could bring a massacre to the camp," said a Syrian rebel near Yarmouk who gave his name as Abu Qusay.

Ironically, Palestinian activists say it was their integration into Syrian society ? facilitated by Assad's regime ? that pushed them into the uprising.

"We have never felt that there was a big difference between the Palestinians and the Syrians," said Abu Omar, the Yarmouk activist. He is 22, has spent his whole life in Syria and was getting a free university education when the uprising broke out.

He dismissed the idea that Assad's regime has been a leader in the Palestinian struggle, pointing out that Syria's border with the Israeli-occupied Golan Heights has been largely quiet since 1974.

In fact, he said he hoped a regime change would help the Palestinians achieve their ultimate goal: the return to their ancestral villages in what is now Israel.

"We have to work together with the free people to liberate Syria, then we'll go to the Golan and liberate Palestine," he said. "We'll work hand in hand."

"Grey's Anatomy"

"Happy Endings"

"Last Man Standing"

"The Middle"

<strong>"The Middle," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Now in its third season, "The Middle" is still holding onto its middle position in the ratings on Wednesday nights, and that seems just about right. It doesn't do "American Idol" or "Survivor" numbers, of course, but with over 7 million viewers, it's a strong comedy for the network that easily beats anything NBC is offering.

"Missing"

<strong>"Missing," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Ashley Judd lead this drama about a former CIA agent whose son goes missing, kicking her back into action to find him. The series was only set to air 10 episodes, miniseries-style, with the potential for more, but a cancellation means that's all they're getting.

"Modern Family"

<strong>"Modern Family," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "Modern Family" remains ABC's biggest sitcom success story of the last decade, both in ratings and awards love. This critical darling is getting a fourth season of hijinks with the hilarious Pritchett-Dunphy clan.

"Once Upon A Time"

<strong>"Once Upon A Time," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "Once Upon a Time" has gotten praise for being one of the more family-friendly dramas on TV, and it's been pulling in close to 10 million viewers each week because of it. We're excited by the almost endless possibilities for new fairy tale-inspired stories to tackle in Season 2.

"Pan Am"

<strong>"Pan Am," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Poor "Pan Am" just never quite took off. The series' vintage look actually worked against it, much like NBC's swiftly canceled "Playboy Club" -- guess when you're being compared to award-winning shows like "Mad Men," it makes it more than a little tough to live up to the hype.

"Private Practice"

<strong>"Private Practice," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> "Private Practice" has never gotten "Grey's Anatomy"-level ratings, and things got shakier when ABC bumped it to Tuesday nights to make room for creator Shonda Rhimes' <em>other</em> new show, "Scandal," but they've given the show a sixth season order.

"Revenge"

<strong>"Revenge," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> With a clever mix of drama, mystery and serious revenge-ing, this is hands down one of the most addictive new shows on TV, and we can't wait to see where they take things in Season 2.

"The River"

<strong>"The River," ABC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> The promise of "Paranormal Activity"-like scares each week quickly fizzled after this show premiered, along with the ratings. The first season's eight episodes came and went, and ABC has nixed any plans for more.

"Scandal"

<strong>"Scandal," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Shonda Rhimes' latest show isn't about doctors at all -- and that's why we're glad it's sticking around. Kerry Washington is amazing as Olivia Pope, a Washington, D.C. fixer with a crack team of specialists helping make bad headlines vanish before they're ever written. Here's hoping for more than seven episodes in its second season.

"Shark Tank"

<strong>"Shark Tank," ABC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Now in its third season, this reality competition show is unlike any other on network TV and ABC is keeping it around for more for that very reason.

"Suburgatory"

"A Gifted Man"

"The Amazing Race"

"The Good Wife"

<strong>"How I Met Your Mother," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> CBS renewed "How I Met Your Mother" for two more seasons in March 2011, so fans can look forward to being strung along about the titular mother's identity for a bit longer.<br />

"The Mentalist"

<strong>"The Mentalist," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Although the show hit a season ratings low in the middle of February, its fanbase and overall ratings were enough to have it return for another season.

<strong>"Mike & Molly," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Thanks to an Emmy win and Oscar nomination, Melissa McCarthy is a Hollywood power player and CBS is keen to keep her around. Just look at the multiple pilots she has in the works as a behind the scenes player! "Mike & Molly" will be back for a third season.

"NCIS"

<strong>"NCIS," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> The long-running procedural has become a ratings juggernaut at a time when most shows start shedding viewers. Season 10 is now happening.

"NCIS: Los Angeles"

<strong>"NCIS: Los Angeles," CBS</strong><br /> <strong>Status:</strong>Renewed<br /> <strong>Why:</strong> This show has gone up in the ratings over the last couple of years, and people can't get enough of L.L. Cool J and Chris O'Donnell.

"NYC 22"

<strong>"NYC 22," CBS</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> This "Rookie Blue" clone from executive producer Robert DeNiro didn't really move the needle when it premiered midseason; CBS officially axed it with three episodes left to air.

"Person of Interest"

<strong>"Person of Interest," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> With ratings matching juggernauts like "Grey's Anatomy" and fans popping up everywhere, we'll be seeing another season of "Person of Interest."

"Rob"

<strong>"Rob," CBS</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> "Rob's" spot after ratings juggernaut "The Big Bang Theory" probably went a long way in helping it survive to see the end of its first season, but that's as far as it'll get.

"Rules of Engagement"

<strong>"Rules of Engagement," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> This show has moved around so much it's hard to remember when it's on, and with six seasons under its belt it's had quite a nice run. Despite slipping ratings and the aforementioned constant switcheroos, there's still a future for "Rules of Engagement."

"Survivor"

<strong>"Survivor," CBS</strong><br /> <strong>Status: </strong>Renewed<br /> <strong>Why:</strong> Of <em>course</em> we have "Survivor" coming back for another season. Where else are we going to see petty squabbles and insane behavior on some of the most beautiful beaches in the world?

"Two and a Half Men"

<strong>"Two and a Half Men," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Despite a less-than-favorable critical response, the revamped "Two and a Half Men" keeps pulling in respectable numbers every week. Ashton Kutcher, Jon Cryer and Angus T. Jones will all return for a Season 10.

"Undercover Boss"

<strong>"Undercover Boss," CBS</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> The inherent addictiveness of this show has gone a long way in securing loyal viewers -- it has been on top of the ratings several times this season alone.

"Unforgettable"

<strong>"Unforgettable," CBS</strong><br /> <strong>Status:</strong> Likely to be renewed<br /> <strong>Why:</strong> In its timeslot, "Unforgettable" keeps emerging on top, beating out "Parenthood" and "Body of Proof." Leading lady Poppy Montgomery has been called "the female version of 'The Mentalist,'" another top-rated show, so things are looking positive.

"90210"

<strong>"90210," The CW</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> While its ratings have plummeted since last season, the Beverly Hills crew is still doing better than "Supernatural," "Hart of Dixie," "Nikita," and "Gossip Girl" on average.

"America's Next Top Model"

<strong>"America's Next Top Model," The CW<br /> Status:</strong> Renewed<br /> <strong>Why:</strong> Tyra Banks' reality show is in the early stages of its 18th cycle with a Brit vs. U.S. installment. Cycle 19 will be the show's inaugural "college edition."

"Remodeled"

"Kitchen Nightmares"

And if Gordon Ramsay's track record with Fox is any indication, it's as good as renewed.

"Mobbed"

<strong>"Mobbed," Fox <br /> Status:</strong> On the bubble <br /> <strong>Why:</strong> It started with a ratings bang, but things have only gone down from there for Fox's flash mob reality show with Howie Mandel at the helm. "Napoleon Dynamite"

Though the reality series underperformed in its Saturday night timeslot, it's not Fox's decision whether or not we'll see more "Q'Viva."

"Raising Hope"

<strong>"Raising Hope," Fox</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Thanks (or no thanks) in part to the success of "New Girl," the sophomore season of "Raising Hope" has moved around timeslots, but it has retained about a 2.1 score in the adults 18-49 demo.

<strong>"So You Think You Can Dance," Fox</strong><br /> <strong>Status: </strong>Too soon to tell<br /> <strong>Why:</strong> Season 9 of "So You Think You Can Dance" won't debut until this summer and when it does, there will be changes: Fox has nixed the results show entirely. If the fanbase is still there, the cheaper production could save the show for another few seasons.

"Terra Nova"

"The X Factor"

Cool, cool, cool -- you can pop, pop! that champagne now.

"Fashion Star"

<strong>"Fashion Star," NBC</strong> <br /> <strong>Status:</strong> Renewed<br /> <strong>Why: </strong>The high-style reality series with Nicole Richie, Jessica Simpson, Elle Macpherson and John Varvatos has certainly been confusing, but it's still a smart business model: The winning designs each week are for sale in stores the next day, and those stores just happen to be covering a large portion of production and advertising costs.

"Fear Factor"

"The Firm"

<strong>"Free Agents," NBC</strong><br /> <strong>Status:</strong> Canceled <br /> <strong>Why:</strong> This show just didn't have much life in it. It was canceled after just four episodes, despite its awesome lead actors Hank Azaria and Kathryn Hahn.

"Grimm"

<strong>"Grimm," NBC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> The supernatural fairy tale drama has been doing well for NBC on Friday nights -- it hovers around the 5 million viewers mark, which is pretty solid by NBC standards and why the network gave the drama an early renewal.

"Harry's Law"

<strong>"Harry's Law," NBC</strong><br /> <strong>Status:</strong>Cancelled<br /> <strong>Why: </strong> While earlier this year "Harry's Law" was one of NBC's top players, after a three-month break between January and March, the Kathy Bates drama saw mediocre ratings and failed to hold on to viewers.

"Parks and Recreation"

<strong>"Parks and Recreation," NBC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> Just like the rest of NBC's Thursday comedy block, "Parks and Recreation" has serious ratings blues. Can critical acclaim keep "Parks" around for a Season 5? The answer is yes! "Parks" will return for Season 5.

"The Playboy Club"

<strong>"The Playboy Club," NBC</strong><br /> <strong>Status:</strong> Canceled<br /> <strong>Why:</strong> Apparently fictional slutty bunnies and real-life homewrecker Eddie Cibrian do not a successful show make. It only lasted three episodes. "The Girls Next Door" did it better.

"Prime Suspect"

<strong>"Prime Suspect," NBC <br /> Status:</strong> Canceled <br /> <strong>Why:</strong> Maria Bello's gruff detective failed to capture the audience NBC hoped. At least we had all those hat jokes. <br />

"Smash"

A handful of episodes in, it stabilized, becoming NBC's #1 drama in the 18-49 demo, and NBC announced it was getting a second season.

"Up All Night"

<strong>"Up All Night," NBC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> The critical favorite of NBC's new comedy offerings, "Up All Night" debuted strongly to more than 10 million viewers, but has since dropped to less than 4 million viewers an episode. It will return for a Season 2.

"Whitney"

<strong>"Whitney," NBC</strong><br /> <strong>Status:</strong> Renewed<br /> <strong>Why:</strong> The show is one of the better performing freshman offerings on the Peacock network -- and NBC chief Bob Greenblatt told members of the press at TCA that he is "hopeful Whitney will be a long-term player for us." Looks like Season 2 is a good start, with the show moving to Friday nights.

"The Voice"
